This week we have seen the swing from discussion of cyber warfare between North Korea and South Korea swing to analysis of pending United States legislation. As to the Koreas whether a possible nation state hack on a bank is war or not is above my pay grade. In my opinion it does not rise to the “break things and kill people” level of conflict. However, there are many examples of wars breaking out over the proverbial “straw that broke the camels back”.
There is an interesting discussion over the authority of the U.S. Department of Defense to wage cyberwar. The discussion at this point seems moot as the creation of cyber command has seemed to overshadow any debate at this time. It is a valid discussion as there are many elements of treaty and international law that should be taken into consideration. There are also Constitutional issues of the military coopting private property to wage war without congressional approval. The assumption that the telecommunications infrastructure is a public commons like the sea ignores the protections of property inherent in the infrastructures. It should be an interesting debate and it may be interesting to see what kind of things the telecommunication carriers wring out of government negotiators.
